Delaware Department of Transportation Begins Enforcing New Sign Laws

Article: "Signs are also forbidden in the state owned right of way outside the Clear Zone, but fines are not attached to those illegal placements."
Comment: The fines apply to the entire state right of way. The only exemption is 30 days before or 30 days after an election.

Article: "For 30 days before and after an election, the law does not apply to candidates' signs"
Comment: The exemption allows any and all types of signs (bake sale, developer, campaign, etc.) outside the Clear Zone during this period of time. If we were to allow only one type of sign, the entire law would be declared unconstitutional.

Article: "Political signs will no longer be allowed in the Clear Zone Dec. 7, 30 days after November's general election."
Comment: Political or otherwise, signs are never allowed in the Clear Zone at any time, 365 days a year. Signs will no longer be allowed in the state right of way outside the Clear Zone Dec. 7, as that is when the 30 day exemption ends.
