Do You Qualify as a Small Business?
If you are a certified disadvantaged business (DBE) with DelDOT, you already meet the standards for a small business and may participate in this program. If you are not a DBE, you may still participate as long as you meet the small business size standards as defined by the Small Business Administration (SBA). A helpful size standards table can be found here: Table of Small Business Size Standards. Three years gross receipts will need to be provided to DelDOT, with the average annual receipts not exceeding $23.98 million.
How the Process Works
- Start by registering to work with DelDOT at deldot.gov/Business/bids/index.shtml?dc=const_contractor_reg
- Bids can be accessed at bids.delaware.gov. You can also register to receive e-mail notifications for particular bid categories.
- Submit your bid.
- Once the bid period closes, DelDOT will review all bids and the lowest bidder will be given ten days to prove that they are an eligible small business* under the rules created by the SBA and the U.S. Department of Transportation (USDOT). Three years gross receipts will need to be provided to DelDOT, with the average annual receipts not exceeding $23.98 million. The bidder must also meet the size limit required by their NAICS code (size limits can be found at sba.gov/sites/default/files/files/Size_Standards_Table.pdf)
If efforts to ensure a firm’s small business status have not been fulfilled within ten days of being named the lowest bidder, the corresponding bid proposal is automatically disqualified from consideration. DelDOT will begin the process of verification with the next lowest bidder, and so on until the size standards are met.
*If the apparent lowest bidder is a DelDOT-certified DBE, the firm is automatically qualified for participation as a small business unless it is determined that more information is needed before a decision can be made. DelDOT will not rely upon, or accept, a small business verification process used by any other entity.
