Entrance Permit System - Frequently Asked Questions

1. Why do I need an entrance permit?

A: DelDOT Entrance Permit is required to construct a new entrance, or modify an existing entrance, in accordance with the Delaware Code, Section 146(c), Chapter 1, Title 17, and the Delaware Administrative Code, Title 2 Del. Admin. C. § 2309-7.2 "DelDOT Development Coordination Manual”.

2. Why should I apply online for a permit?

A: Applicants are strongly encouraged to submit their Application forms online via the DelDOT website to ensure expedited processing of their Permit Application request.

4. How do I submit an application?

To submit an application for DelDOT Entrance Permit, click the following web link, Entrance Permitting System and choose the county in which you would like to apply for a permit.

The online application system will guide you through the steps to fill out and submit the application for DelDOT Entrance Permit. Link to help manual Entrance Permitting System.

5. How can I check the status of my application?

You can check the status of a submitted Application online. Please click on the below link Entrance Permitting System or by contacting the DelDOT District Public Works office. Please keep applicants first name, last name or companies’ information ready (if applied for commercial permits) and the Application ID.

6. Which types of entrance permits can I submit online?

The following Entrance Permit types can be submitted online:

  • Residential
  • Poultry Farms
  • Commercial
  • Agricultural
  • Temporary
  • Solar Farm

7. What documents do I need to submit with my online application?

How do apply for a Solar Farm Entrance Permit?

Solar Farm applications are required to be submitted to the Public Works office, in accordance with the Entrance Permit Process for Solar Farm Applications.

8. What is Source of Supply and who should submit it?

Source of supply are all materials used in right of way construction; concrete, paving, aggregate base, striping. The sources must be pre-approved by DelDOT lab prior to construction. These are typically submitted by the contractor. There are specific forms and procedures for submittal.

9. How and where should be the source of supply information shall be sent?

Please include the Contract/Permit/Agreement number pertaining to your project on all communication.

Attached is a copy of the newest SOS Submittal Form for your convenience as well as an example on how to fill it out.

10. What types of documents require original signatures, and must be mailed or hand-delivered to DelDOT for submittal?

Entrance Permit Documents printed, hand signed, scanned and uploaded by citizens are acceptable

Power of Attorney forms can be accepted online and shall have original signatures and should be notarized.

Security Documents can be uploaded online with the application but original must be submitted to the district office.

All the above mentioned documents can be uploaded online but originals must be submitted in the office. Applicant can mail them or hand deliver.

11. Can I submit security document online?

Security documents cannot be submitted online or by e-mail. Original security documents such as Letter of Credit, Surety Agreement, Escrow Agreement and Escrow certified check must be mailed or hand delivered to DelDOT with original signatures on all documents. Copies or scans of security documents will not be accepted.

12. How to request extension of the permit expiration date?

Requests for extensions of expiration date may be submitted by e-mail or letter to the applicable

13. Do I need an email address to apply for a Permit online?

Applicants are strongly encouraged to submit their Application forms online via the DelDOT website to ensure expedited processing of their Permit Application request. If the Applicant does not have access to a computer , or does not have any e-mail address, then contact the applicable DelDOT Public Works office for coordination of submittals via mail, or by visiting the District Public Works office at address shown below for hand-delivering of document submittals:

14. What is a security pin?

A security pin is a four digit number that applicants will be prompted to create before submitting an online application. This four digit pin is a static pin meaning that it will not/cannot be changed, once set. Applicant will need this pin number to login and check the status of their application post submittal. Therefore, it is highly recommended that the pin must be saved somewhere to remember.

15. Do I require a new pin every time I login to the system?

No. the four digit security pin is static and will/cannot be changes once set.

16. Can I retrieve my security pin if I forget?

Yes, the user can retrieve the pin information from Forgot Pin
User will need the application/permit number/last name in order to retrieve their pin number.

17. How can I reply to the discussions initiated by DelDOT?

DelDOT may respond to the Applicant’s online Application by requesting additional information or clarification. The Applicant may respond to these requests by attaching additional documents to the online application, or by adding comments within the online application. The applicants can only submit their response once, after they are contacted by DelDOT. If needed, the applicant may also respond directly by e-mail to DelDOT.

18. How many days does it take for DelDOT to review and approve an entrance Permit application?

DelDOT will review and comment on your Permit application form within 15 calendar days of submittal of all required supplemental documentation. If additional information is required, then DelDOT will notify the Applicant, and specify the additional submittal requirements. If all required information is submitted, and if your request is deemed acceptable for approval, then DelDOT will authorize your Permit request within 15 calendar days of submittal.

19. Am I required to apply for a DelDOT Permit if the entrance already exists?

The Application submittal process for existing entrances is the same as for proposed new entrance construction or entrance modifications. For example, if the Applicant proposes to construct a building addition, then Applicant must apply for a DelDOT Entrance Permit online. The online Application form process will ask you to clarify if the entrance is existing, proposed new, or proposed modification to existing entrance.

20. Why did I receive a Letter of No Contention (LONC) or Email of No Impact (EONI)?

DelDOT will review your application submitted online. If the entrance is existing, and DelDOT determines that no entrance modifications are required, then DelDOT may issue a "waiver"document. This document may be issued in the form of an e-mail or letter from DelDOT to the Property Owner, and to the County.

21. Can I apply for a Letter of No Contention (LONC) or Email of No Impact (EONI) online?

The Application submittal process for requesting a DelDOT "waiver"or similar document is the same as for proposed new entrance construction or entrance modifications. For example, if the Applicant is requesting a waiver document form DelDOT to use existing entrance for car sales, or for house reconstruction, then the online Entrance Permit Application process will ask you to clarify your intent to use existing entrance. DelDOT will review your request, and determine if you are eligible for issuance of a waiver document.

22. How long does it take to obtain a LONC or EONI from DelDOT for use of existing entrance?

DelDOT will review and comment on your Application within 15 calendar days of submittal of all required supplemental documentation. If additional information is required, then DelDOT will notify the Applicant, and specify the additional submittal requirements. If all required information is submitted, and if your request is deemed acceptable for approval, then DelDOT will authorize your Permit or waiver request within 15 calendar days of submittal.

23. Where can I find the State regulation governing the issuance of DelDOT Entrance Permits?

The DelDOT Development Coordination Manual is the State regulation describing all requirements for issuance of DelDOT Entrance Permits. This manual can be viewed at Development Coordination Manual.

24. Who can sign the permit application?

The owner must sign the permit application. If the application was submitted online than the owner must sign the downloaded pdf "Permit of Entrance Construction”. If there is an equitable owner/developer listed on the plan they are eligible to sign. If other than the owner, a notarized Power of Attorney must be provided.

25. What if my tax parcel number does not validate.

If the tax parcel number entered by the user does not validate then a pop message will appear on the screen ‘please check and enter the tax parcel number again. If the tax parcel does not validate, continue to the next step’

26. Who pays for the work to install my residential entrance drainage pipe?

DelDOT has different policy for properties within three counties, concerning installation cost responsibility for drainage pipes.

In Kent County (Central District), for the first residential property owner is responsible for the purchase of the pipe and DelDOT will install the entrance drainage pipe. If it is the second entrance or relocation for the property owner is responsible for all materials and labor.

In Sussex County (South District), property owner is responsible for furnishing the purchase of the pipe and DelDOT will install the entrance drainage pipe.

In New Castle County (Canal District), property owner is responsible for furnishing and installing the entrance drainage pipe (if required). The property owner is also responsible for all costs related to furnishing and installing the entrance drainage pipe.
